Terms and Conditions

By placing an order on heartandink.co.uk, you agree to be bound by these Terms and Conditions.
1. The Products
Handcrafted Nature: Our products are handcrafted. Slight imperfections or variations in the frame or mounting are part of the bespoke nature of the product and are not considered faults.
Colour Accuracy: Please note that colours on a digital screen (phone/monitor) may look slightly different from the final printed ink product due to screen calibration.
2. Ordering and Photos
Image Quality: The quality of the final print depends heavily on the quality of the photo you upload. We are not responsible for pixelation or blurriness caused by low-resolution source images provided by the customer.
Intellectual Property: By uploading a photo, you warrant that you own the copyright to the image or have full permission from the owner to use it. You agree to indemnify Heart and Ink against any claims of copyright infringement regarding images you supply.
Refusal of Service: We reserve the right to refuse to print images that are offensive, explicit, or incite hatred.
3. Returns and Cancellations (Important)
Customised Goods Exemption: Under the Consumer Contracts Regulations 2013, goods that are "made to the consumer’s specifications or are clearly personalised" are exempt from the standard right to cancel or return items within 14 days.
No Returns on Bespoke Items: As every piece we make is custom-made using your personal photo, we cannot accept returns or cancellations once production has begun.
Faulty Goods: If your item arrives damaged or there is a manufacturing fault, please contact us at heartandinkuk@gmail.com within 48 hours of delivery with photos of the damage. We will arrange a replacement or refund.
4. Design and Third-Party Tools
We use professional software and occasionally third-party tools to edit and stylise your photos. By placing an order, you agree to us processing your image through these tools for the purpose of fulfilling your order.
5. Delivery
We will attempt to deliver your order within the estimated time frame. However, delays caused by the courier (Royal Mail/couriers) are outside our control. We are not liable for missed deadlines unless a guaranteed delivery service was selected and paid for.
6. Liability
To the fullest extent permitted by law, heart and ink shall not be liable for any indirect or consequential loss. Our total liability shall be limited to the purchase price of the product.
7. Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
